OMAHA, Neb. —

Immigration and Customs Enforcement confirmed to KETV Investigates that the man detained by ICE agents at an Early Bird restaurant in Omaha was in the country illegally.

On Tuesday, KETV Investigates obtained video showing a man being taken to the ground inside Early Bird's west Omaha location on June 1.

He is cuffed and later can be seen being escorted out of the restaurant.

On Wednesday, the assistant secretary for the Department of Homeland Security's public affairs told KETV Investigates that any allegations that the man was "wrongfully taken" by ICE are false.

In a statement, an ICE spokesperson told KETV that on June 1, special agents were in search of a "Guatemalan national with a final order of removal" in Omaha.

The special agents saw someone matching that description and followed him to the Early Bird location, where they attempted contact, officials said.

As the agents approached, that person fled into the restaurant and resisted arrest before being taken into custody, the ICE spokesperson said.

ICE confirmed that the employee seen in the video was in the country illegally from Guatemala, working under a fraudulent name and Social Security number.

Officials said the man, who is the 26-year-old brother of the original target and "closely resembles him," also had a prior immigration encounter in 2022 involving false documents.

An ICE spokesperson said a special agent sustained a minor injury during the pursuit.

Early Bird corporate posted on social media Tuesday, saying, "We had no involvement or knowledge of this incident prior to living it alongside our guests and staff."

"Due to the sensitive nature of this matter and out of respect for the individual's privacy and legal process, we will not be releasing any further details. We remain committed to creating a respectful, lawful, and inclusive work environment!"

While KETV has confirmed the man's identity, we are not releasing it at this time until the case against him moves forward.

The Hearst National Investigative Unit learned he's being held at the Pottawattamie County jail.

The attorney representing the man told KETV that he was scheduled to be deported Wednesday, but he was able to work with ICE attorneys to call off the flight.

This afternoon will be a lot like yesterday. It will be mostly sunny and breezy with highs in the mid 60s for Omaha. Northeast of Omaha, neighborhoods will be in the low 60s. Southeast Nebraska won't be as warm as yesterday, but should still make it into the upper 60s.

The wind lightens up early tonight, and we drop into the mid 40s for Friday morning.

A few hit and miss showers will start to move into eastern Nebraska just ahead of the morning commute, but a lot of us will be dry heading into work. Scattered rain will be around eastern Nebraska and western Iowa through the afternoon and evening. More than half of us should see rain, but there will be areas that stay dry all day. This keeps us mostly cloudy and a touch cooler with low 60s for the afternoon. Any leftover rain should end Friday night.

Saturday will be mostly cloudy and breezy with highs in the upper 60s. Most of the day looks dry, but late in the afternoon, a few spotty showers will start to move in from the west. The rain will become more widespread Saturday evening and night, with a lot of us seeing some of the wet weather.

Some of Saturday's rain could spill over into Sunday morning, but most of us will be dry the rest of Sunday. It will still be mostly cloudy and breezy in the afternoon with mid 60s.

Memorial Day will also be cool, but any chance for rain is still looking very small. It will be mostly cloudy with mid 60s, which is more than 10 degrees below average.

Tuesday will be closer to 70, followed by mid 70s on Wednesday. Both days bring a little more sunshine, but we keep a slim chance for rain.

OMAHA, Neb. (WOWT) - Another round of potentially strong thunderstorms are expected for Monday night. This is why today through tonight is a First Alert 6 Weather Day.

8:20 PM - Tornado Watch has expired early ending the severe risk for Monday night.

7:20 PM - A Flood Warning has been issued for Saunders County until 9 AM Tuesday morning. 2-3″ fell over areas like Wahoo which could lead to flooded roads over rural locations.

6:27 P.M. - The latest tornado warning expired early, but severe thunderstorm warnings remain.

5:58 P.M. - Two tornadoes confirmed earlier: one near North Bend and another near Pawnee City. New tornado warning issued for far southern areas west of Falls City until 6:45 P.M.

5:51 P.M. - Tornado no longer on the ground in North Bend but rotation still indicated. Warning in effect until 6 PM.

5:34 P.M. - Tornado warning issued for North Bend, NE until 6 PM. The Fremont Rural Fire Department confirmed a tornado was on the ground near McGinns Lake, located between Rogers and North Bend.

5:25 P.M. - Tornado warning issued for far southern Nebraska near Pawnee City until 6:15 PM. Radar indicated rotation.

5:05 P.M. - Tornado Warning continues until 5:15 PM for Schuyler with numerous severe t-storms warnings.

A Tornado Watch has been issued for many counties including the metro until 9 PM tonight.

Storms are likely to start developing shortly after 4pm and will continue to grow in coverage and intensity into the evening. Large hail, strong wind and a few tornadoes are all possible from the strongest storms. You can see how the storms grow from 5pm to 6pm on this model. The best chance for these storms will be south of I-80.

Another area to watch will be a line of storms from the west that could create strong storms over the metro. It’s not as high of a chance, but it’s still a possibility.

By midnight or so most of the storms should be east or weakening for the rest of the night with some lingering showers possible the rest of the night. More spotty showers are likely Tuesday too and that should keep us much cooler along with the clouds. Bank on a couple of windy days today and tomorrow aside from any showers as well.
