BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2025 MetroDesk Media, LLC) — Boca Raton restaurant “Tin Fish” at 9101 Lakeridge Bouleveard the home to live roaches, improperly dated food, and a “mold like” substance. A health inspector ordered the restaurant closed on April 1st, according to records just provided to BocaNewsNow.com. The restaurant was permitted to reopen the following day.

Tin Fish, at 9101 Lakeridge Boulevard, was ordered to close on April 1, 2025. It was permitted to reopen on April 2, 2025.

The owner of a Boca Raton shopping plaza has unveiled an ambitious plan to breathe new life into the property, including expanded grocery options and over 300 apartments.

Atlanta-based Selig Enterprises has filed an application in Boca Raton through the state’s Live Local Act to redevelop a shopping center with a larger Publix and apartments.

The developer originally filed a land use amendment with the city for the 23.18-acre Palmetto Park Square at 1401 W. Palmetto Park Road in early 2024. It called for a larger Publix and 319 apartments to replace much of the other retail space. The land use amendment would have required City Council approval.

Now, Selig Enterprises has filed a Live Local Act application for the site instead. The law allows developers to bypass city density and height rules to build multifamily or commercial- or industrial-zoned sites, as long as 40% of the units are workforce housing for people making up to 120% of area median income. A public hearing is not required.

That means Selig Enterprises is seeking administrative approval from the city for its new plans.

Built in the 1970s, Palmetto Park Square currently has 196,200 square feet of retail, including a 28,000-square-foot Publix. Selig Enterprises has owned it since 1982. The nearly 100,000-square-foot Kmart there closed in 2019.

Under the Live Local Act proposal, the former Kmart building would be replaced by a 50,000-square-foot Publix and 17,080 square feet of additional retail. In the second phase of the project, the developer would build 341 apartments in five stories, a parking garage and 11,380 square feet of new retail. As per the Live Local Act, 40% of those apartments will be for people making up to 120% of area median income.

The median household income in Palm Beach County is $104,000, according to HUD.

In addition, about 30,000 square feet of existing retail would remain and undergo renovations.

According to the developer, its traffic study showed that the multifamily-focused project would generate significantly less traffic than its current use as a shopping center.

“We are grateful for the input we have received from the community and are excited to be making this significant investment in Boca that will transform the property into a mixed-use environment where guests and residents can shop, dine, and enjoy the outdoors in one place,” said Hunter Lainhart, VP of development at Selig Enterprises.

The developer said the two-phase project would take about three years to complete.

Many older shopping centers across South Florida have been redeveloped with multifamily as property owners meet the need for more housing in the region, and multifamily often generates more revenue than retail. The Live Local Act has facilitated more of these projects by allowing more density and preventing city boards from blocking them.

“The City of Boca Raton takes part in the National Flood Insurance Program’s (NFIP) Community Rating System (CRS), a voluntary incentive program that recognizes and encourages community floodplain management activities that help reduce flood risk,” said an advisory issued Wednesday to BocaNewsNow.com.

“Through recently increased floodplain management activities, the City’s improved CRS Classification now qualifies City residents for a larger discount on their flood insurance premiums. The discount increased from 15% to 25% for residents in all flood zones. If you are unsure of your discount status, please contact your flood insurance provider.”

While the discount is available to many City of Boca Raton residents, we remind you that a “Boca Raton” address doesn’t necessarily mean that you live in the City of Boca Raton. Transplants moving to West Boca — especially from New York — often have a problem understanding this. The City of Boca Raton is making it easy to follow along. An embattled private equity firm has suffered another setback in court. Discover the details of this latest judgment and its potential impact.

A Miami-Dade County Court ruled in favor of The Boca Raton for a lawsuit the resort filed against an embattled private equity firm over unpaid event fees.

The court ordered Miami-based 777 Partners to pay more than $800,000, comprising $556,400 in damages and $251,300 in interest, calculated at an annual rate of 18% due to delayed payment.

To satisfy the judgment, the court issued garnishment orders on 777’s bank accounts with City National Bank of Florida and Goldman Sachs. CNB of Florida reported that the private equity firm holds nearly $350,000 in its accounts. Goldman Sachs has yet to respond to the garnishment order.

Boca Owner LLC, the parent company of The Boca Raton – Boca Beach Club, filed a complaint last August against 777 for a breach of contract tied to a $1.5 million event the private equity firm held in January 2023. The complaint said that while 777 made partial payments toward the event bill, it allegedly defaulted on the final installment due in December that year.

The resort issued two notices of default and claimed that, although 777 made additional payments, it failed to pay the full balance. At the time the lawsuit was filed, the outstanding amount was over $727,000, plus 1.5% monthly interest.

Scott M Wellikoff, the attorney who represented 777 in its lawsuit with The Boca Raton, did not immediately respond for comment.

777 has been in the center of a number of legal battles, including an eviction lawsuit last July over its 600 Brickell headquarters after the company allegedly failed to pay rent as of June 1, 2024.

In that case, the court backed a default judgment motion from landlord Brickell Holdings LLC on Jan. 27 after 777 failed to respond to the complaint.

A 777 spokesperson has yet to acknowledge any of the Business Journal's requests for comment on the company's active legal proceedings. The company's website is no longer active, and its phone number is not in service.
